What You Need to Know About Personal Injury Claims

  • Insurance companies will be looking for gaps between when you were injured and when you were treated to avoid paying your claim, so seek treatment immediately, even for seemingly minor injuries.

  • Don’t post anything that would compromise your claim on social media while your case is still open. This includes performing rigorous exercises or activities while claiming you can’t work due to your injuries.

  • Create a paper trail of your injuries. Mention to the officer at the scene that you feel sore so that they notate it in the accident report. Mention every ache and pain to your physician as soon as possible.

  • As your personal injury attorneys, we are investing our time and energy in you and your case, so we need you to be just as invested in your case and medical treatment. Be sure to follow your physician’s treatment plan and our recommendations as closely as possible so that you can recover what you are entitled to.

  • Personal injury claims are settled after you are done with treatment. During treatment for your injuries, you will need to make arrangements with your provider to pay or submit through your health insurance. Insurance companies do not like speculative or future treatment and will usually only pay for the treatment you have already received.

  • Filing a personal injury claim does not mean you are suing the other person or going after their assets. You are simply opening a claim with their insurance for the compensation for injuries that you are legally entitled to. This is why everyone carries insurance.

  • Always hire an experienced personal injury attorney. You will almost always pocket more from your claim with the help of an attorney than without. Don’t worry about what hiring an attorney costs, because they get paid the more they help you claim.

  • Optional insurance add-ons like Medpay and uninsured/underinsured coverage are always a good idea. They are not chargeable or at-fault claims so use them when you need them.

WHAT ARE TYPES PERSONAL INJURY ACCIDENTS?
    AUTO ACCIDENTS
    • Have you been injured in an auto accident? You could well be entitled to damages due to the driver’s negligence in failing to abide by commonly followed driving practices or due to everyday distractions like texting, emailing, and eating while driving. Defective components are another source of automobile, truck, and motorcycle accidents. Responsibility for the proper function of your vehicle, or the vehicle that struck you, could lie with the companies responsible for designing, manufacturing, selling, and servicing the vehicle.
    BURN INJURIES
    • Burns are a major source of injuries in the home, in the workplace, and on the road while traveling. Very often burn injuries are caused by the negligence of businesses or other individuals. Burn accidents in the home could be caused by defective materials or wiring that was improperly installed. Workplace and industrial accidents are other sources of common burn injury claims.
    CATASTROPHIC INJURIES
    • At SeiferFlatow, we understand that care and coping with catastrophic injuries is expensive and demanding upon both those that are injured as well as family members and loved ones. We will help you pursue the best options for care and management of your injuries in addition to pursuing appropriate compensation for both the direct and indirect harm done to you. There are numerous care options for catastrophic injuries depending upon the nature and severity of the injury or injuries, options that include both professional care facilities and at-home options for care.
    CONSTRUCTION ACCIDENTS
    • Heavy machinery and dangerous equipment are factors in many on-the-job accidents that result not only in deaths but life-changing injuries. Once an injury or death occurs at a construction site, it becomes crucial to sort out the events and entities involved in the case as soon as possible. You will need an experienced personal injury attorney to carefully review all the facts for you.
    HEAD OR BRAIN INJURIES
    • Head and brain injuries are often a result of motor vehicle accidents, assaults, and falls. Understanding of the impacts of brain injuries resulting from sports and recreation activities is growing in addition to the impacts of head and brain trauma suffered by members of the military. Injuries can be temporary or they can have long terms impacts on the physical and cognitive abilities, as well as emotional health of the injured party. In many cases, these injuries are the result of negligence on the part of another person or entity.
    MOTORCYCLING INJURIES
    • A Charlotte attorney at SeiferFlatow knows about the consequences resulting from motorcycle accidents and is ready to assist riders who need representation after a collision.
    TRUCK ACCIDENTS
    • Truck accidents can wreak havoc on victims and their families. Causes of this type of accident range from trucking company negligence, mechanical defects, overloading and lack of training to driver fatigue, driver error, intoxication, and distractions such as texting. Whether you were a pedestrian, a driver, or a passenger involved in an accident, you may be entitled to compensation if a negligent party caused your injuries.
OTHER TYPES OF PERSONAL INJURY CASES
    DOG BITES
    • One of the most frightening things a person can endure is a dog bite. Every year in the United States, more than 4.5 million people are the victims of such an encounter. Victims of Charlotte dog bites can seek legal recourse, thanks to North Carolina laws pertaining to a dog owner’s liability. SeiferFlatow has the know-how required to represent clients in these types of cases.
    NURSING HOME NEGLIGENCE
    • Cases involving negligence at nursing homes are one of the most disturbing types of abuse as our elderly suffer at the hands of providers that they rely upon for daily care. Unfortunately, these cases are also, it seems, on the rise in North Carolina and across the country. SeiferFlatow is available to assist families of nursing home residents who suspect their loved ones are being neglected, mistreated, or abused.
    SLIP AND FALL ACCIDENTS
    • If you injure yourself by slipping and falling while on another person’s property (whether a residence or a workplace site), you may be able to file a premises liability claim. Adam M. Seifer and Andy A. Stein are skilled at handling claims for people who are injured in a slip and fall. We can help you to review the facts, determine if the property owner’s negligence is responsible for your injuries, and – if need be – help you file a claim.
    DEFECTIVE MEDICAL DEVICES
    • Medical devices provide essential daily support functions for many Americans when working properly. Unfortunately, there are times that things can go terribly wrong with these devices, causing significant pain, inconvenience, and trauma to the patient reliant upon the medical device. If you or a loved one has been injured by the malfunction of a medical device, it could be time for you to contact a personal injury attorney in order to better understand the damages that you might be entitled to recover.
    PRESCRIPTION DRUG DISPENSING ERROR
    • Since the year 2000, the U.S. FDA has received more than 95,000 reports of prescription drug dispensing errors. Factors that contribute to medication errors – such as substandard training, inadequate staffing, and poor record-keeping – persist. Our attorneys at SeiferFlatow are ready to help individuals and their family members with cases involving medication errors.
    PRODUCT LIABILITY
    • If you have been injured due to a product’s defect or malfunction, you may be eligible to file a product liability claim. Claims can be based on negligence, strict liability, or breach of warranty of fitness. You may sustain physical, mental, and/or financial injury with a product liability claim.
    WRONGFUL DEATH
    • When a person dies due to the negligent actions of another individual, it’s often best for loved ones to seek counsel from an experienced attorney. Although the period after a loved one dies is stressful, it is important to take swift action if you are going to file a wrongful death claim.
TYPES OF DAMAGES YOU MAY RECEIVE AFTER A SUCCESSFUL PERSONAL INJURY CASE

You may receive your medical bills paid in full.

If necessary, well-documented, and not speculative, you may receive compensation for future treatment.

You may receive lost wages as long as you are out of work, with your doctor’s notation and documentation to support it.

You may receive compensation for pain and suffering, often referred to by clients as “what I have had to go through.”

Our team will investigate all aspects of the incident that resulted in your injuries. We'll identify everyone who played a role in causing your injuries.

Our team will look for all potential sources of insurance coverage that may be responsible for paying you compensation for your losses.

We'll use our trusted resources, included experts focused on accident reconstruction, medical diagnostics, life care planning, financial planning, and others. This helps us to plan for the longevity of your recovery and any long-term impacts you'll need to be prepared to face.

We'll communicate with insurance adjusters and defense attorneys on your behalf to reach terms of negotiation (or prepare for trial).

Our paralegal team will closely track all paperwork filing deadlines and keep you informed when you're required to submit information. When we handle actions in your case or file on your behalf, we'll keep you posted on the status of each aspect of your case.

Our team is experienced in court litigation and will be ready to argue aggressively on your behalf if the insurance company refuses to reach our settlement terms.

    DID YOU RECEIVE AN OFFER?

Insurance companies and their lawyers often make settlement offers that are far too conservative in order to pad their bottom line and reduce the money paid to you. These settlement offers are a preemptive effort to make your case go away rather than dealing with it in a fair and just manner.

If you have received an offer from an insurance company or its attorney for a Charlotte personal injury case, we would be happy to review the proposed settlement to see if it is one that is fair and includes all just compensation. If the offer is not a fair one, we will inform you of how we can help you to pursue a just settlement. In the event that the offer is one that is deemed fair and addresses all compensation due, you will not be charged for our time.
