As a lawyer and a small business owner, Mathew views his cases with a singular focus: to solve the problems faced by his clients. Mathew has extensive experience as a trial lawyer who has handled complex cases such as non-compete violations involving billion-dollar multi-national corporations, inflammatory defamation attacks against local businesses, catastrophic personal injury cases and million-dollar contractual disputes. Since co-founding SeiferFlatow, PLLC in 2011, he has focused on achieving the best possible results for every client embroiled in a legal dispute or requiring personalized legal advice. He has presented or cross-examined experts in more than a dozen disciplines, including accounting, forensic accounting, economics, human resources, psychology, epidemiology, pulmonology, radiology, internal medicine, orthopedic surgery, toxicology, accident reconstruction and structural engineering.

Over his career, Mathew has tried more than 100 cases and argued before numerous courts across the country, including U.S. courts of appeals, U.S. district courts, North Carolina State Superior Court, North Carolina State District Court, North Carolina State Business Court and the North Carolina Industrial Commission. An invited instructor for law school trial advocacy and mediation programs, Mathew regularly speaks on a variety of litigation topics, including strategic case development.

Litigation

Federal Complex Litigation Stukes v. Antney et. al.: Verdict in excess of $600,000 for Client after suing international music mogul for fraud and received judgment in Federal Court.

Injunction to Change Fake Review on National Website Represented a National pool contractor who had fake reviews put on a website called RipoffReport.com. Aided client by getting a declaratory judgment that required the website to change the fake posting. Also helped client recoup damages from the competing business that put up the fake reviews.

Defamation against a Business: Thibeau and Phone Ninjas, LLC v. Bryant: The suit of Thibeau and Phone Ninjas, LLC v. Bryant resulted in an award of $200k for loss of earnings and emotional distress. SeiferFlatow, PLLC earned a decisive victory in Mecklenburg County Superior Court which resulted in a $200k award after presenting details in a case involving harassment against an individual and his business. The case involved a digital attack through fake attributions on adult sites, as well as fake reviews left on a business Facebook page. The jury’s deliberation in this case, as well as the conclusion of the six day trial, took place under extenuating circumstances. The pandemic, named COVID-19, had shuttered court operations, however this trial was allowed to conclude. The jury’s deliberation lasted 90 minutes.

Workers’ Compensation

Ellen A. v. Lance, Inc. $301,040.00: settlement on a workers’ compensation case where client badly injured her knee at work. Case involved complex issues with Medicare. Case was resolved favorably for client through a settlement that provides for her future medical needs.

Transactional Law

Non-Compete Case Involving Multi-National Companies NuVasive v. Kormanis: Represented a Medical Sales Representative who went from one large medical device company to another. When the client was sued in Federal Court by his former employer, Mathew undertook the extensive litigation. The case required depositions in multiple states, a large number of briefs, expert witnesses and novel areas of law. My client was successful at summary judgment having four of the causes of actions dismissed by the Court. The Judge also struck the Plaintiff’s expert report. Following these rulings, and before trial, the parties were able to reach a mutually agreeable resolution to the case.

Contractual Business Disputes Owen N. Coumas v. Sinister Skate Shop, LLC: Secured a Judgment for $280,000 when the majority shareholders in a Lake Norman company improperly expelled client (minority shareholder) from their skateboard business, but kept his investment, claiming he violated the ethics clause in their operating agreement.

Employment Law

Employment Law – Sexual Harassment Sexual Harassment in the Workplace Case – Obtained a six-figure settlement for a pair of women were sexually harassed and subsequently terminated from their job. Case was resolved at mediation

After spending his childhood in Winston-Salem, North Carolina, Mathew earned a degree in political science at the University of Notre Dame in Notre Dame, Indiana, and then returned to his hometown to attend Wake Forest University School of Law. After graduation, Mathew settled in Charlotte, where he quickly began building relationships in the city’s legal and business communities. With this broad professional network, Mathew is uniquely positioned to provide legal services to individuals and businesses in Mecklenburg County.

Mathew was admitted to the state of North Carolina Bar in 2006.

Getting Personal

After spending his formative years in Winston-Salem, North Carolina, Mathew settled in Charlotte, where he quickly began building relationships in the city’s legal and business communities. Mathew and his wife stay busy running businesses and raising three girls. Mathew was a competitive golfer in his youth, and also enjoys basketball, softball, and tennis throughout the public parks in Charlotte.
