Landlord-Tenant Laws in North Carolina

North Carolina law mandates that your landlord keep your housing fit and safe to live in. NC law also says the tenant must pay rent, keep the home clean, and not do any damage to the home. Security Deposit Limit and Return

NC law limits how much a landlord is allowed to charge for a security deposit. For month-to-month rental agreements, the security deposit cannot be more than one and a half month’s rent; for longer rental agreements, the deposit cannot be more than two month’s rent. It must be returned within 30 days after a tenant moves. 

Tenants can sue for the return of their deposit. This takes place in small claims court. 

Required Landlord Disclosures

NC requires landlords to disclose to tenants specific information – like the name and address of the bank where the security deposit is kept – in the lease or rental agreement. All types of information the landlord is required to disclose to the tenant can be found here.

Late Fees and Other Rent Rules

NC law regulates rent-related issues like late fees and how much time a tenant has to pay overdue rent before the landlord can file for eviction. In NC, a tenant has 10 days to pay overdue rent or move out. 

If the landlord fails to take care of important repairs, the tenant has the right to withhold rent or exercise the right to “repair and deduct.” 

Termination and Eviction Rules

In North Carolina, if a tenant violates a lease term that specifies noncompliance will result in eviction, the landlord can give the tenant an unconditional quit notice. If the tenant does not move out immediately, the landlord has the right to file for eviction.
